It is hereby agreed that “Partner Organization” will abide by the following terms:
1. Recipient representative will verify and sign for product at time of physical transaction.
2. Items will be used to care for the needy.
3. Goods will not be bartered, traded or sold for any reason by your organization. This includes flea markets, garage and yard sales, thrift shops, auctions, raffles, charity benefits, fundraising events, or in any other context whatsoever. Items may not be given to volunteers, officers, clergy, or employees for personal use, unless those individuals are in need. If any of these should occur, the organization may lose its privilege to pick up food and supplies indefinitely.
4. The recipient meets all requirements of IRC Section 170(e)(3).
5. The recipient organization and any and all associated individuals will hold harmless and indemnify Fort Worth Hope Center (FWHC) and anyone acting on FWHC’s behalf from and against all liabilities as to the products given to your organization by FWHC, FWHC’s actions, your actions, the actions of your organization, the products transferred to you and your organization, and any legal/ and or other enforcement action taken against you or your organization for the use and/or abuse of these products. This includes the liability for any injury to person or property incurred or suffered while picking up/taking delivery of items at or from FWHC.
6. Neither FWHC, nor any donor of products to FWHC, warrants or guarantees these products in any way. The recipient will assume all risk of use.
7. The recipient will provide documentation of the number of individuals served to FWHC for record and accounting purposes. This documentation must be provided quarterly, and failure to comply may result in the suspension of service.
8. The recipient agrees to pay fuel surcharges to help offset the cost of transporting product.
On behalf of “Partner Organization”, I have completely read, understand, and agree to be bound by these terms. I also certify that I am acting as an authorized representative for this organization, and that I have legal authority to bind my organization to the slated terms, and that all who are served by my organization will agree to be bound to the same terms.
This agreement shall be in effect until canceled, in writing, by either party.
Fort Worth Hope Center reserves the right to serve whoever they choose to serve.
